(“Trux”, “we” or “our”) has made its mission to provide high quality, exciting, innovative products for retailers and owner operators in the automotive, trucking and agricultural industry.  As the leader in exterior accessories for Class 8 trucks, Trux will always strive to offer excellence and knowledge on the latest technological advancements and trends.

We take privacy and compliance with applicable privacy laws seriously and are strongly committed to being transparent about our privacy practices. HOW AND WHY WE COLLECT PERSONAL INFORMATION

For the purposes of this policy, Personal Information is any information about an identifiable individual, including any information that, alone or in combination with other available information, could be used to identify an individual (“Personal Information”).  Personal Information does not include aggregated information, or any Personal Information that has been de-identified through the removal of potentially identifying details, such that the data may not be reasonably identified with a particular individual.

We collect Personal Information from our customers and potential customers, website visitors, suppliers and distributors.  We collect a range of Personal Information, including contact information, account information, biographical information, purchase and transaction history information, and information about product and Services preferences.  We also use common electronic technologies, such as cookies, which track your device’s interaction with our website, including browsing and location information. We use your Personal Information for the following primary purposes:

  • to communicate with you, offer products and services, and sell goods;
  • to deliver products and services, resolve complaints, warranties, and offer credit;

We do not sell or trade Personal Information with other companies. From time-to-time we may engage in joint-marketing with other reputable companies or institutions, but do not give such companies access to Personal Information for their own purposes.

We may provide your Personal Information to a third party where reasonably required in the context of a sale, merger or amalgamation of all or part of our business. In any such case, the recipient parties will be contractually required to keep the information confidential and use it only for the purposes of the transaction, or proposed transaction, in question. We and our service providers may disclose your Personal Information in response to a search warrant or other legally valid inquiry or order, or as otherwise required or permitted by applicable law, including the disclosure of Personal Information where necessary for the establishment, exercise or defense of legal claims or to prevent actual or suspected loss or harm to persons or property.

PROCESSING OF PERSONAL INFORMATION BY THIRD PARTIES

From time to time, Trux may share your Personal Information with third party contractors and service providers that we have engaged to provide us with services or to perform services on our behalf, based on our instructions, such as data processing and storage companies or individuals and organizations that provide professional and administrative services to us.  We will limit our disclosure of your Personal Information to such third parties to that which is reasonably necessary for the purpose or service for which the third-party service provider is engaged.  We will use contractual and other means to provide a comparable level of protection while the information is being processed by such third parties, including limiting such providers to using your Personal Information solely to provide Trux with the specific service for which those providers were engaged, and for no other purpose. Some third-party service providers that we may engage may store or process your Personal Information in the United States or other jurisdictions other than Canada, where it may be subject to the laws of the jurisdiction in which it is stored.

COOKIES AND RELATED TECHNOLOGIES

We collect Personal Information related to your visits to our website. This information includes device, browsing and location information. Through log files, viewing and other technologies, we collect the IP (Internet protocol) addresses of all visitors to our websites and other related information such as page requests, browser type, operating system and average time spent on our websites. This information is collected to facilitate a more optimal browsing web browsing experience (including providing appropriate content for your region) and collect statistical information about how this website is being used.

Cookies

Like most websites, our website uses a technology called “cookies”. A cookie is a tiny element of data that our website can send to your browser, which is stored on your device and records your preferences and your use of the website so we can recognize your browser/device when you return. We use cookies to help us understand our website activity and which areas of our website are useful and which areas need improvement. You may set your browser to notify you when you receive a cookie or to not accept certain cookies. Tracer Tags & Web Beacons

Our website may also use a technology called “tracer tags” or “Web Beacons”. A web beacon is a small transparent graphic image that allows us to record simple user actions related to our websites and to email communications received from us, to help us determine the usage and effectiveness of our site and communications.  These “images” are automatically loaded to your browser/device when you visit the website or open an html format email message from us, thereby letting us know if a certain page was visited or an email message was opened. This technology allows us to understand which pages you visit on our website and which email messages were opened. These tracer tags are used to help us optimize and tailor our website for you and future visitors.

Web Analytics

We may use a third party such as Google Analytics to help us gather and analyze information about the areas visited on the websites (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the convenience of the websites. Do Not Track

Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals.  If you block cookies, certain features on our sites may not work.  If you block or reject cookies, not all of the tracking described here will stop.

HOW WE SAFEGUARD PERSONAL INFORMATION

We have implemented reasonable and appropriate physical, organizational and technological safeguards designed to protect against unauthorized access, use, modification and disclosure of Personal Information in our custody and control. Our safeguards include the use of encryption and de-identification tools.

While Trux makes strong efforts to safeguard your Personal Information and to secure your data, no transmission of data over the Internet can be guaranteed to be 100% secure.

RETENTION OF PERSONAL INFORMATION

We retain your Personal Information only where required to fulfil the purposes set out in this Privacy Policy, and for no longer than necessary to fulfill those purposes or as otherwise permitted or required by law. Certain third-party service providers, like payment processors, may have their own retention policies and legal requirements related to retention. When we no longer have a legitimate need to retain your Personal Information, we will securely destroy or irrevocably erase it.

We value your choices when it comes to your Personal Information. You generally have the right to withdraw your consent to any further collection, use or disclosure of any elements of your Personal Information, subject to legal and contractual requirements; however, such a withdrawal may reduce your ability to take full advantage of our Services.

CHILDREN’S PRIVACY

Our website is not intended for use by children under the age of 16, and we do not knowingly collect Personal Information from such children through our website. If you are under 16, please do not give us any Personal Information. If we learn that we have collected the Personal Information of such a child we will take steps to delete the information as soon as possible.

NOTICE TO RESIDENTS OUTSIDE OF CANADA

Trux is headquartered in Canada.  Personal Information may be accessed by us or transferred to us in Canada or to our affiliates, business partners, or service providers elsewhere in the world. If you are located outside of Canada, please be advised that any information you provide to us will be transferred to and stored in Canada and that, by submitting information to us, you explicitly authorize its transfer and storage within Canada. We will protect the privacy and security of Personal Information according to this Privacy Policy regardless of where it is processed or stored.

CALIFORNIA PRIVACY NOTICE

The California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), requires us to make specific disclosures about how we collect, use, disclose the personal information of California residents who are subject to CCPA (we call this specific personal information “PI”). CCPA also grants such California residents certain rights related to their PI. This section describes our PI practices offline and online and contains these required disclosures and instructions for California residents who wish to exercise their rights under CCPA. Please note that, to the extent permitted under CCPA, this California Privacy Notice does not apply to the PI of California residents that we collect for employment-related purposes.

The chart below provides a description of the types of PI we may collect. It also describes the business or commercial purpose(s) for which we may collect, use and disclose PI, and the categories of third parties with whom we have shared or sold each type of PI in the past twelve (12) months. Below the chart, we have outlined the criteria we use to determine how long such PI will be retained. The CCPA contains specific definitions for “sharing” PI and “selling” PI. These definitions only apply to this California Privacy Notice, and do not apply to the rest of our Policy. “Share” or “sharing” means, in short, sharing PI for cross-contextual advertising purposes. “Sale” or “selling” is defined very broadly and includes the disclosure of PI for monetary or valuable consideration. Note that as of the date of the Policy, we do not knowingly “sell” PI, including the PI of consumers under the age of 16 years. This statement is based on our understanding of how these terms are defined under CCPA.

Our PI retention criteria: The CCPA requires that we disclose the criteria we use to determine how long we will retain each category of PI in the chart above. Oftentimes, our records contain several of these categories of PI combined together and therefore we consider, on a case-by-case basis, a number of factors to assess how long PI is retained. These factors include what PI is reasonably necessary to (i) provide our products and services or administer our relationship with a consumer; (ii) protect our business, employees, organization and others; (iii) fulfill our legal and regulatory obligations; and (iv) investigate and address issues which may include safety concerns, potential security incidents or policy violations.

Disclosures for Business Purposes: In the past twelve (12) months, we have disclosed the categories of PI described in the chart above for business purposes. We have not disclosed this information to third parties (e.g., non-service providers) in the past 12 months.

California resident rights under CCPA. Subject to certain exclusions included in CCPA, and as relevant to our operations, California residents have the rights listed below with respect to the PI that we maintain about them. We may take steps to verify your identity, as permitted or required under CCPA, before we process your request. Verification may include asking you to provide information about yourself that we can match against information already in our possession.

  • This means that you can request that we disclose what PI we have collected about you, including the categories of PI, the categories of sources from which the PI is collected, the business or commercial purpose for collecting, selling, or sharing PI, the categories of third parties to whom we have disclosed PI, and the specific pieces of PI we have collected about the consumer.
  • This means that you can request that we delete PI about you which we have collected from you.
  • This means that you can request that we correct inaccurate PI that we maintain about you.
  • Opt-Out of Sale or Sharing of PI. CCPA provides a right to opt out of the “sale” or “sharing” of PI. Note that as of the date of this Policy, we do not knowingly “sell” PI, including the PI of consumers under the age of 16 years. This statement is based on our understanding of how these terms are defined under CCPA.
  • Limit the Use or Disclosure of Sensitive PI. The CCPA provides a right for consumers to request that business limit the use or disclosure of their “sensitive” PI. In our normal business operations, we do not process “sensitive PI” as that term is defined under CCPA. Please do not submit this information to us.
  • Right to Non-Discrimination. This means that we are prohibited from discriminating against you if you exercise your rights under CCPA.

California residents who wish to exercise their rights under this section can contact us privacy@truxaccessories.com or by filling out our Contact Us form. Please include your name, email address and address and indicate you are a California resident making a “CCPA” request. Agents that you have authorized to act on your behalf may also submit CCPA requests as instructed above. The agent must also provide evidence that they have your written permission to submit a request on your behalf. If we are unable to verify the authenticity of a request, we may ask you for more information or may deny the request.

Additional California Rights: Pursuant to Section 1798.83 of the California Civil Code (known as the “Shine the Light Law”), residents of California have the right to request from a business, with whom the California resident has an established business relationship, what types of Personal Information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. Trux will endeavor to respond to such requests within a reasonable time by providing a report that includes the information required by applicable law.  Please be advised that Trux is not required to respond to requests from any individual resident under the Shine the Light Law more frequently than once per calendar year.

OTHER US STATE PRIVACY RIGHTS

In addition to California, several other states may provide their residents with certain rights regarding the collection and use of their personal information. The categories of personal information that we process, and the purposes for which we process your personal information, are described above.

Under these state laws, you may have the right to:

  • Confirm whether or not we are processing your personal information and provide access such personal information.
  • Delete personal information provided to us by or obtained by us about you.
  • Provide you with a copy of your personal information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
  • Correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of your personal information.
  • Provide a method for you to opt-out of the processing of your personal information for purposes of online behavioral advertising, the sale of your personal information, as the term “sale” is defined under the relevant state privacy law, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
  • Opt out of certain types of profiling.

In addition, if you are a Nevada resident, under Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A (“603A”), you have the right to submit a verified request to us, directing us not to make any sale of certain “personal information” as defined under this law that we have collected or will collect about you.
